Article 1 – Glossary
For the purposes of these Terms of Use, the following terms have the meanings set out below:
- Client area: the personal area of the Site that the client can access after approving the quote, by entering their contact details and username. Once REIDROCHA has approved the account and provided the login details, this area will give the client access to their Personal data and to a platform for sharing information and documents dedicated to developing the project.
- Cookie: a small digital file or "tracer" placed on the visiting internet user's hard drive by the site's server. This file does not personally identify the visitor but optimises their access to the Site: it recognises the device used by the visitor (and not its user) in order to make it easier to access the various pages of the Site. This system makes it possible to measure the audience of the Site's pages, making it easier to analyse internet users' behaviour (for example: browser configuration and language, dates and times of visits, history, etc.) and the resulting marketing actions to optimise the customer experience (improving the site interface, personalising services, content displayed). The management of Cookies is covered by a Cookie Policy.
- Personal data: information relating to a natural or legal person, provided by the internet user and/or collected by the Site. It makes it possible to identify such persons directly or indirectly (examples: name, postal address, e-mail, telephone number, SIRET number, VAT number, IP address, computer login ID, etc.). The expression "personal data" therefore covers both the "nominative data" that the visitor provides to REIDROCHA, in particular when registering (surname, first name, address, e-mail, etc.), and "electronic identification data", meaning all the information created or calculated from the visitor's computer during their visits to the Site, which does not allow any direct identification.
- Parties: the legal or natural person using the Site, and REIDROCHA.
- Profile: information provided by the internet user when registering and opening their account. The visitor can access the personal data concerning them, the community area and the features of the Site.
- Site: the REIDROCHA website available at the following address: https://www.reidrocha.com.
- Visitor or internet user: means, for the purposes of these Terms of Use, any natural or legal person who visits the Site.
Article 2 – Acceptance of the Terms of Use
2.1 The purpose of these Terms of Use of the Site (hereinafter "the Terms") is to set out the rules for the use of and access to the Site by all visitors, who are invited to read them very carefully and to keep a copy.
2.2 Access to the Site and its services is subject to the unreserved acceptance of these Terms. By the mere fact of connecting to the Site, the visitor undertakes to comply strictly with each of its provisions. If they do not accept them, the visitor must stop using the services of the Site.
The applicable Terms are those in force on the date on which the visitor connects to and uses the Site.
The internet user acknowledges that they have the legal capacity to accept these Terms. If the visitor is a minor or an adult lacking legal capacity, they expressly declare that they have the authorisation of the holder of parental authority or of their legal representative to accept these Terms.
2.3 The Terms may be updated at any time, in particular to bring them into line with any changes in legislation and regulations. Any change takes effect immediately, as soon as it is published online. The visitor is therefore invited to consult regularly the latest version of the Terms, permanently available on the Site via the Terms of Use link at the bottom of the home page.
2.4 The temporary non-application of one or more clauses hereof may in no way be interpreted as a waiver by REIDROCHA of its right to rely on any of those clauses. If one or more provisions of these Terms were declared null and void or inapplicable, the other provisions would retain their full force and scope and would continue to apply in full.
Article 3 – Use of the site – REIDROCHA's liability
3.1 REIDROCHA uses its best efforts to secure continuous access to, consultation and use of the Site for all internet users, within the limits of these Terms.
However, REIDROCHA reserves the right to carry out unilaterally the maintenance operations necessary for the proper functioning of the Site, in particular to make the changes required by technical developments or for the continuity of services.
The internet user is informed of REIDROCHA's right to close the Site temporarily or permanently, in particular for maintenance operations.
3.2 The constraints and limitations of the Internet cannot be attributed to REIDROCHA. The internet user is solely responsible for any damage suffered and/or any loss of data resulting from downloading material while using the Site. In particular, it is up to them to take appropriate measures to protect their data and their IT and digital equipment against any form of intrusion and/or contamination by viruses.
The internet user is informed that the use of a "proxy" (a software component that acts as an intermediary to filter exchanges between a private local network and the internet) may prevent the connection to the Site's services from working. In that case, they are advised to uninstall the proxy.
3.3 REIDROCHA cannot be held liable in the event of force majeure as recognised by French case law.
3.4 The internet user expressly releases REIDROCHA from any liability for the conduct they may adopt after consulting the Site.
Article 4 – Internet user's liability
The internet user is solely legally responsible for the use they make of the Site.
The internet user accessing the Site undertakes to behave in a normal and reasonable manner and not to hinder, in any way whatsoever, the proper functioning of the Site. In particular, they undertake not to take any action likely to disrupt, slow down, block or alter the normal flow of data exchanged in the course of using the Site and/or to disturb the normal functioning of the Site.
4.3 Certain interactive services of the Site require an access code and a password. Access codes and passwords are strictly personal and confidential information. The visitor (or user of the Site) is responsible for managing and safeguarding them and for the consequences of their use. They therefore undertake not to disclose them in any form whatsoever to third parties and are informed that any disclosure is made under their sole responsibility.
Article 5 – Intellectual property
5.1 It is expressly stated that the Site and the information published on it are reserved for personal use.
5.2 All the elements appearing on the Site, in particular the graphic charter, visual elements and texts, are protected by copyright, database producers' rights (Article L.341-1 of the Code de la propriété intellectuelle [French Intellectual Property Code]) and other intellectual property rights, and REIDROCHA and/or its licensors hold all the corresponding rights. The REIDROCHA trademark is a French trademark registered with the INPI in the name of REIDROCHA. The domain name reidrocha.com and the rights to the Site's logo belong to REIDROCHA.
Consequently, any reproduction or representation without the express authorisation of REIDROCHA is strictly prohibited and may give rise to civil and criminal liability for its author on the basis of the provisions of the Code de la Propriété Intellectuelle and/or of unfair competition and parasitism. REIDROCHA reserves the right to bring proceedings before the competent courts against any natural or legal person responsible for one or more unauthorised uses and/or exploitations of elements of the Site.
The internet user undertakes to inform REIDROCHA, as soon as they become aware of it, of any unlawful or non-contractual use of all or part of the Site in breach of its rights (copyright, trademark rights, etc.) or those of its licensors, whatever the means of distribution used, using the contact details given in the Site's legal notice.
Article 6 – External links to third-party sites
The Site contains hyperlinks giving access to third-party websites.
As these sites are published by third-party natural or legal persons, REIDROCHA cannot be held responsible for the content published on them. Likewise, REIDROCHA cannot be held responsible for any collection and transmission of Personal data, installation of Cookies or other processes implemented by these third-party sites.
Article 7 – Governing law and competent jurisdiction
7.1 The internet user may submit complaints to the Site's publication director, whose contact details are given in the legal notice.
7.2 REIDROCHA is legally responsible only for the French version of this site; any translation of texts on the Site is provided to internet users for information purposes only. The official language of the Parties in the event of a dispute is French.
These Terms are governed exclusively by French law.
In the event of a dispute, the Parties are obliged to attempt to reach an agreement before taking any legal action.
Failing this, any dispute relating to these Terms, their interpretation, validity and consequences, wherever the parties are located, shall be subject to the exclusive jurisdiction of the Tribunal Judiciaire de Mulhouse, including in the event of multiple defendants or third-party claims.
